Limits and parameters on local and state regulation of wireless communication

This is an old Extension bulletin (1983, revised in 1996) and now out-of-print. This is out-of-date, with changes brought about by the adoption of the Michigan.

At the start of 2013, significant new restrictions were placed on local governmental authority to regulate the expansion and location of wireless service facilities, in addition the restrictions on local regulations already in place.  This publication reviewed and explained those the limits on local authority from (1) the Federal Telecommunication Act, (2) the Sequestration Act, and (3) the Michigan Zoning Enabling Act. But in 2014 the FCC Rule on this subject was adopted (effective January 15, 2015). Thus this publication is now out-of-date. By Kurt H. Schindler, AICP.
